1. 协议的接受
欢迎使用 LensEats。本《用户协议》(以下简称"本协议")是您(以下简称"用户"或"您")与万岛游(天津)旅行有限公司(以下简称"万岛游"或"我们")就 LensEats 应用(以下简称"本应用")的使用所订立的协议。当您下载、安装、注册、登录或以任何方式使用本应用时,即视为您已阅读、理解并同意接受本协议的全部条款。如您不同意本协议任一条款,请立即停止使用本应用。
2. 服务说明
本应用是由万岛游开发并运营的一款移动端 AI 工具,主要功能为:
- 通过相机或相册图片,对餐厅菜单进行 OCR 识别与多语种翻译;
- 根据您设置的过敏原偏好,对菜单中的菜品给出过敏原提示;
- 提供菜单原币种与目标币种的实时汇率换算展示;
- 提供"服务员点餐辅助"语音播报功能。
本应用不含任何广告,不提供餐厅预订、订餐、配送等线下交易服务。
3. 免费与会员服务
- 免费用户:每日可享 3 次免费菜单扫描,无广告。
- VIP 会员:无每日扫描次数限制,并享受优先处理通道。
- 会员定价:具体价格以您发起订阅时 Apple App Store 内显示的金额为准。我们保留在合理通知后调整价格的权利;价格调整不会影响您当前订阅周期内已支付的部分。
4. 订阅与计费
VIP 会员通过 Apple App Store 的应用内购买(IAP)方式订阅,相关付款由 Apple 处理,本应用不接触您的银行卡、Apple ID 密码或任何支付凭证。订阅条款:
- 自动续费:订阅默认开启自动续费。如不希望续费,请在当前订阅周期结束前 24 小时,前往 iPhone 设置 → Apple ID → 订阅 中取消。
- 退款政策:由于内购退款由 Apple 统一处理,请通过 reportaproblem.apple.com 向 Apple 申请退款。
- 试用期:若提供首周优惠/试用期,将在订阅页面明确标注;试用期结束后自动转为正式订阅,您可在试用期内随时取消。
5. 用户行为规范
您承诺在使用本应用的过程中遵守中华人民共和国法律法规,不利用本应用从事任何违法、违规、不道德或损害他人合法权益的活动。您不得:
- 使用本应用从事任何违反《网络安全法》《数据安全法》《个人信息保护法》及其他法律法规的活动;
- 对本应用进行反向工程、反编译、破解、修改或制作衍生作品;
- 利用任何自动化脚本、爬虫或其他技术手段恶意刷取免费扫描配额;
- 采用任何方式干扰、破坏本应用服务器及基础设施的正常运行;
- 上传含有非法内容(包括但不限于色情、暴力、恐怖、反动、侵犯他人版权的内容)的图片;
- 冒用他人 Apple ID 进行订阅,或使用任何非法手段获取 VIP 服务。
一经发现上述违规行为,我们有权立即暂停或终止您的使用权,且无需事先通知。
6. AI 准确性免责声明
本应用使用第三方 AI 大模型(阿里云通义千问)进行图像识别与翻译。AI 输出的结果可能包含错误、遗漏或不准确之处,包括但不限于:菜品名称翻译不准、价格识别错误、过敏原标注遗漏等。
过敏原提示功能仅供参考,不构成医学建议。若您或同行人对特定食物有严重过敏史,请务必在点餐前直接向餐厅服务员核实成分,切勿仅依赖本应用的提示作为食用决策依据。因此造成的任何过敏反应、健康损害或其他后果,万岛游不承担责任。
7. 知识产权
LensEats 的软件代码、UI 设计、图标、商标(含"LensEats"、"万岛游"、"Wandao Tour"等文字与图形商标)、文案、产品逻辑等所有知识产权,均归万岛游所有。我们授予您一项个人的、非独占的、不可转让的、可撤销的有限许可,仅用于您个人非商业性地使用本应用。
未经我们书面同意,您不得复制、修改、出租、出售、转售、分发、传播、出版本应用任何部分,或基于本应用开发衍生产品。
8. 服务变更与中止
我们可能基于业务调整、技术升级、合规要求等原因,变更、暂停或终止本应用的全部或部分功能。对于重大变更,我们将通过应用内通知、邮件或本网站公告的方式提前告知您。在以下情况下,我们可能中止服务而无需提前通知:
- 定期或紧急的服务器维护;
- 因不可抗力(包括但不限于自然灾害、战争、政府行为、网络中断)导致的服务异常;
- 用户违反本协议或法律法规,被监管部门要求停服。
9. 责任限制
在法律允许的最大范围内,万岛游对您使用本应用过程中产生的任何间接、附带、偶然、惩罚性或后果性损失(包括但不限于利润损失、数据丢失、商业机会损失、过敏反应、错误点餐造成的经济损失等)不承担责任。
万岛游对本应用承担的全部赔偿责任总额,在任何情况下不超过您在过去 12 个月内向万岛游实际支付的订阅费用总额。
10. 协议变更
我们可能根据业务发展、法律法规变化或监管要求,适时修订本协议。修订后我们将在本页面顶部更新"最后更新"日期,并通过应用内通知告知您。您在本协议修订后继续使用本应用,即视为您已接受修订后的全部条款。如您不同意修订内容,请立即停止使用本应用并卸载。
11. 适用法律与争议解决
本协议的订立、生效、履行、解释及争议解决,均适用中华人民共和国法律(不含港澳台地区法律)。
因本协议引起或与本协议有关的任何争议,双方应首先友好协商解决;协商不成的,任一方均可向万岛游(天津)旅行有限公司住所地(天津市河东区)有管辖权的人民法院提起诉讼。

1. Acceptance of Terms
Welcome to LensEats. These Terms of Service ("Terms") form an agreement between you ("User", "you") and Wandao Tour (Tianjin) Travel Co., Ltd. ("Wandao Tour", "we", "us") governing your use of the LensEats application ("the App"). By downloading, installing, registering for, or otherwise using the App, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you disagree with any part of these Terms, please stop using the App immediately.
2. Description of Service
The App is a mobile AI utility developed and operated by Wandao Tour. Its main features are:
- OCR-based recognition and multi-language translation of restaurant menus via camera or photo-library images;
- Allergen alerts on dishes based on your stated allergen preferences;
- Real-time exchange-rate conversion between the menu's source currency and your target currency;
- A "waiter ordering assistant" voice-broadcast feature.
The App contains no advertising and does not provide restaurant reservations, ordering, or delivery services.
3. Free and VIP Tiers
- Free tier: 3 free menu scans per day, no advertisements.
- VIP subscription: Unlimited scans, priority processing.
- Pricing: The price is the amount displayed in the Apple App Store at the moment you initiate the subscription. We reserve the right to adjust prices with reasonable notice; such adjustments will not affect the portion you have already paid in the current billing cycle.
4. Subscriptions and Billing
VIP subscriptions are sold via Apple's In-App Purchase (IAP) and billed by Apple. The App never accesses your bank card, Apple ID password, or any payment credential.
- Auto-renewal: Subscriptions auto-renew by default. To cancel, go to iPhone Settings → Apple ID → Subscriptions at least 24 hours before the end of the current term.
- Refunds: All in-app refunds are handled by Apple. Request a refund at reportaproblem.apple.com.
- Trial period: If a free-trial / introductory price is offered, it will be clearly labeled at the point of purchase. The subscription converts to the regular price automatically at the end of the trial; you may cancel at any time during the trial.
5. Acceptable Use
You agree to comply with the laws of the People's Republic of China when using the App, and not to use the App for any unlawful, fraudulent, or harmful activity. Specifically, you must not:
- Use the App in violation of the Cybersecurity Law, Data Security Law, Personal Information Protection Law, or any other applicable laws;
- Reverse-engineer, decompile, modify or create derivative works based on the App;
- Use scripts, bots, or other automated means to circumvent the free-scan quota;
- Interfere with, disrupt, or overload our servers or infrastructure;
- Upload images containing unlawful content (including but not limited to pornographic, violent, terrorist, copyright-infringing material);
- Subscribe using someone else's Apple ID, or otherwise obtain VIP service through illegitimate means.
We may suspend or terminate your access immediately and without prior notice upon discovering any of the above violations.
6. AI Accuracy Disclaimer
The App relies on third-party AI large models (Alibaba Qwen) for image recognition and translation. AI output may contain errors, omissions, or inaccuracies, including but not limited to mistranslated dish names, incorrect price recognition, and missed allergen warnings.
The allergen-alert feature is for reference only and does not constitute medical advice. If you or anyone dining with you has a severe food allergy, always verify ingredients with restaurant staff before ordering; do not rely solely on the App's output. Wandao Tour shall not be liable for any allergic reaction, health harm, or other consequence resulting from such reliance.
7. Intellectual Property
All intellectual property in the App — including software code, UI design, icons, trademarks ("LensEats", "万岛游", "Wandao Tour"), copy, and product logic — belongs to Wandao Tour. We grant you a personal, non-exclusive, non-transferable, revocable limited license to use the App for personal, non-commercial purposes.
Without our prior written consent, you may not copy, modify, lease, sell, redistribute, publish, or build derivative products based on any part of the App.
8. Service Changes and Suspension
We may modify, suspend, or discontinue all or part of the App's features for business, technical, or compliance reasons. For material changes we will notify you in advance via in-app message, email, or this website. We may suspend service without prior notice in the following cases:
- Scheduled or emergency server maintenance;
- Force majeure (natural disasters, war, government actions, network outages, etc.);
- You violate these Terms or applicable laws, and a regulator orders us to suspend service.
9. Limitation of Liability
To the maximum extent permitted by law, Wandao Tour shall not be liable for any indirect, incidental, consequential, exemplary, or punitive damages (including but not limited to lost profits, data loss, lost business opportunity, allergic reactions, or financial loss from incorrect orders) arising out of or in connection with your use of the App.
Wandao Tour's total cumulative liability under or in connection with these Terms shall in no event exceed the total amount of subscription fees you actually paid to Wandao Tour in the 12 months preceding the claim.
10. Changes to These Terms
We may revise these Terms from time to time in response to business developments, legal changes, or regulatory requirements. The "Last updated" date at the top of this page will be revised accordingly, and we will notify you via in-app message. Continued use of the App after revisions constitutes acceptance of the revised Terms. If you disagree, please stop using the App and uninstall it.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the People's Republic of China (excluding Hong Kong, Macau, and Taiwan).
Any dispute arising out of or in connection with these Terms shall first be resolved through friendly negotiation; failing that, either party may bring legal action before the competent People's Court in Hedong District, Tianjin (the registered address of Wandao Tour).
